IMAGINE FLOAT PRIVACY POLICY

This Privacy Policy applies to data collection and security practices of Imagine Float, LLC ("Imagine Float", "us", "our", or "we") regarding our products and services, including operation of our website:  www.imaginefloat.com (the "Site", and collectively, with our products and services, the "Services"). We are committed to protecting the privacy of your information. We will use the information that you provide to us as described below. Whenever you provide personal information or other information about someone other than yourself, you are warranting that you have that person’s consent to provide such information for the purpose specified. 

By using the Services and/or providing your personal information, you confirm your acceptance of, and agree to be bound by this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services or input any information. Your acceptance of this Privacy Policy authorizes us to use and disclose your personal information in accordance with this Privacy Policy.

1. Collected Information.  

An Imagine Float "Customer" is an individual that has signed up for an Imagine Float Service and/or purchased Services or Products from Imagine Float. A "Visitor" is an individual considering scheduling and purchasing products and services from Imagine Float. Customers, Visitors, and all other users of the Site are collectively referred to as "user" or "you". When you purchase a product, schedule or utilize the Services, we may collect certain information directly from you that you provide to us, as well as information that is automatically or passively collected from other sources, such as from your browser or device. All information collected in connection with the Products/Services is sometime referred to herein as "Collected Information". Collected Information includes any information we may collect directly from what you provide to us when purchasing the product, booking a Service or completing required waiver or other forms, as well as information that is automatically or passively collected from other sources, such as from your browser or device.

Purchases/Waivers. When you make purchases with us, and at other times in your use of our Services, we may ask you to provide information which may personally identify you and/or allow us to contact you, such as your name, phone number and email address, user name and password, billing address, credit card number, products and services purchased, date of purchase, information about your health, and information about your computer and software. We do not process or maintain your credit card information. We utilize a third-party service provider to process your payments. Your credit card information is not retained by us, but online booking requires you to store a credit card. Your credit card information will be stored in an encrypted manner. 

Device, Usage, and Location Data. When you access the Services, we may use certain tracking technologies and logs used to help us diagnose problems with our server, administer the Site, and to otherwise provide our Services to you.  These may automatically collect standard web log entries for each page served, including your IP address, page URL, browser type, and language, access times, referring website addresses, information you search on the Site, date and timestamps associated with Site access and usage, system configuration information, metadata concerning the files that you upload/download, and other interactions with the Site and/or Services. 

2. How Imagine Float May Use or Disclose Information.

Operation of Services and our Business. The personal information you provide, in combination with other information collected, will be used to provide the Services, including operation of the Site, to improve the quality of our Services, and to provide you with a better experience. Specifically, it may be used to: (i) provide you with important information about the product or service that you are using, including critical updates, notifications, and product announcements; (ii) diagnose problems with the Services; (iii) provide and improve functionality and user-friendliness of our Services, including the Site; and (iv) better understand your needs and interests, and personalize and improve your experience. Additionally, in the event Imagine Float sells or transfers some or all of its assets, whether as a part of bankruptcy, liquidation or similar proceeding, the information it collects may be disclosed to, and your personal information may be among those assets transferred.

Communications with you. We may use your information for communications with you, including for sending confirmation emails, authenticating your purchases, and for marketing of our Services to you. We distribute a newsletter via the email address you provide to us. If you no longer wish to receive this newsletter from us, you may "unsubscribe" by following the instructions in the email. If you affirmatively opt-in at the time of enrollment on the Site or sometime thereafter, Imagine Float will send you recurring automated personalized communications and promotional marketing text messages to the cell number and/or email address associated with your opt-in. Message and data rates may apply. If you do not want us to use your contact information to send you appointment reminders, to book an appointment, inquire about our services, or to promote our Services, you can opt-out at any time by adjusting your preferences in your account profile on the Site or by notifying us at the email address set forth in Section 9 below.  You may receive an additional text and/or email message confirming your decision to opt-out. You understand and agree that the foregoing options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.  

Aggregated Information. Imagine Float may disclose information in the form of aggregate data regarding user behavior, which do not identify any individual user.

3.  Security 

To secure your information, we have put in place commercially suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect on our Site. 

Nonetheless, the transmission of information via the internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically on our Site, and transmission of such data is therefore entirely at your own risk.

4. Service Providers

This Privacy Policy applies to Imagine Float only. However, as we work with third-parties in connection with the operation of the Services and our business, those third-parties may collect or have access to your information necessary or appropriate for the function and operation of the Site and our business. Imagine Float may share Collected Information with our Service Providers (as defined below) for such legitimate purposes as: (a) contacting users who have provided contact information on our behalf; or (b) providing and monitoring the Service to ensure the quality of information provided through diagnostics. Imagine Float does not sell, rent, or trade any identifiable information about you with third-parties for their promotional purposes. Imagine Float uses HelmBot.com for online booking services which in turn uses Amazon and various other service providers. HelmBot’s privacy policy can be found here. Collectively, HelmBot, Amazon, and their affiliates as well as any other service providers that we work with from time to time are referred to as "Service Providers."  When you enter information on our booking application and on our waivers, you are entering such information through our Service Providers and are subject to their privacy policies. Imagine Float uses HelmBot, Nextiva and Google Voice for text messaging service and MailChimp for email marketing.

Imagine Float may also provide links to third-party websites, or you may wish to authorize us to connect with different services to perform actions on your behalf. Please be aware that any such links or performance of actions on your behalf are for your convenience only and it is your responsibility to be aware of and comply with the various terms of use and privacy policies of such third-parties. We do not have any control over the privacy policies of third-party websites and are not responsible for the privacy or security practices of any third-party. 

5. Users Only of Legal Age of Majority

Our Site is designed and intended for those who have reached the age of majority (18 years of age). By using our Site, you affirm that you are at least 18 years of age or older.  We are not liable for any damages that may result from a user’s misrepresentation of age. 

 

No one under age 13 is authorized to submit or post any information, including personal information, on our Site. Under no circumstances may anyone under age 13 use our Site.  Parents or legal guardians of children under 13 cannot agree to these terms on their behalf.

6. Legal Disclosure

We reserve the right to disclose Collected Information to the appropriate third-parties under the following circumstances:

a. As required or permitted by law, such as to comply with a subpoena, court order or other legal process.

b. When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

c. To any other third-party with your prior consent to do so.

7. Correcting and Updating Information

You may update or change your registration information by updating your profile settings. We will attempt to handle all requests to access, change, or delete your Collected Information within 30 days, but do not guarantee that such request will be fulfilled within that time period.

We will retain your Collected Information for as long as your account is active, as needed to provide you the Services including access to the Site. If you wish to cancel your account or request that we no longer use your Collected Information to provide you with the Services or access to the Site, please contact us at the email address listed at the end of this Privacy Policy. We will retain and use your Collected Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

8. Changes to this Privacy Policy

Please note this Privacy Policy may change from time to time. If we materially alter this Privacy Policy, we will notify you of such changes by e posting a notice to the Site. Accordingly, we strongly encourage you to periodically review this Privacy Policy, most importantly, before you provide Imagine Float with any personal information. Your continued use of the Site or Services after any changes to this Privacy Policy constitutes your acceptance of the revised Privacy Policy. If you do not agree to the changes, please do not continue using the Site or Services, and you should notify us that you do not want your information used in accordance with the changes.
